Signatures submitted by Deuba are genuine

Senior Advocate Shambhu Thapa has argued that the signatures submitted by Nepali Congress President Sher Bahadur Deuba before President Bidya Devi Bhandari seeking his appointment to the post of the Prime Minister are genuine.

The Senior Advocate said so while pleading over the case of dissolution of House of Representatives (HoR) at the constitutional bench comprising Chief Justice Cholendra Shumsher JB Rana and Justices Deepak Kumar Karki, Meera Khadka, Ishwor Prasad Khatiwada and Dr Ananda Mohan Bhattarai.

Senior Advocate Thapa opined, "Signature should be collected on the spot wherever one (lawmaker) is found. If there is falsification, take action against them. That is not the jurisdiction of the Attorney General. They can do it without asking for a paper; the signature is done in another sheet of paper if there is no space in the first.”

Arguing that not only the rights of NC President Deuba but also the rights of 146 lawmakers who have filed writ petition has been curtailed, he argued.

President Bhandari had to take decision considering that the Prime Minister had already confessed that he could not get vote of confidence in the parliament, Thapa said in his reply debate in the SC.

With this, the reply debate has concluded today. Amicus Curiae would begin after a tea break and four Amicus Curiae members have been given two hours to make their statement. The Amicus Curiae consists of senior advocates Raghav Lal Baidya and Usha Malla from Nepal Bar Association and senior advocate duo Komal Prasad Ghimire and Prakash Bahadur KC from the Supreme Court Bar Association.
